On June 23, 2025, the Receiver distributed an additional $1,750,000.00 to the U.S. Treasury, bringing the total amount distributed to date to $10,750,000.00.

Only about $40 million to go to meet Judge Nuffer's $50 million judgment in what he called a "Massive Fraud".

Methinks it's highly unlikely that judgment will be met. The question remains ... now what?

In other legal action ...

There were 200 or so US Tax Court cases that were filed by those poor suckers who actually believed the Fairy Tale told by IAS/RaPower3 key players. After the IRS said "no go" in a test case, it was appealed and they lost again. There are still over 100 cases outstanding (why?). Until they concede, penalties keep piling up.

Documents say an officer with the FBI Child Exploitation Task Force conducted undercover online chat operations posing as a 13-year-old girl, and was contacted by someone using the name “fundaddy,” later identified as Shepard.

As the officer reported being a 13-year-old girl, documents say Shepard replied that was the same age as his daughter.

The same age as his daughter?

Maybe we should all go down to the jail and welcome him home.

His wife divorced him while he was in jail, so I wonder where he will be calling home?

There are those of you out there who are probably displeased with the way he promoted the solar lenses.

He ended up costing those who claimed the tax credit the amount of the credit they claimed (if any), the depreciation they claimed (if any), and the interest on the amount due from the date of the year they filed for the credit. And, any state income tax adjustments.

And, loss on IAUS stock they purchased (if any).

There were about 200 taxpayers who petitioned the IRS after having their tax returns questioned. They relied on a test case, but the IRS won the test case. They appealed the ruling, then lost again. So all those petitioners were left with an IRS debt. Most of those petitioners still haven't come to a "Stipulated Decision" with the IRS, so interest on their debt continues to pile up. Many of those petitioners were frequent posters on the old Raging Bull investment forum.

And, there were many other taxpayers who voluntarily paid their debt after receiving notice from the IRS that the credits were not legal.

Some of you may have forgotten why Matt Shepard was in jail. Following are links explaining it all, and a nice picture of him:

The Indictment in this case was returned by the grand jury on December 8, 2021. The defendant is years old and has been diagnosed by Dr. Marc Nuttall, an oncologist, “with stage four cancer” and “is terminally ill.” His “prognosis is that his condition will not improve” and is unable “to attend court” or “withstand the riggers of a trial.” For these reasons, the United States submits that dismissal of the Indictment, without prejudice, is appropriate

There can be no "Guilty" verdict returned if Neldon is physically unfit to attend a trial.

So maybe "Neldon wins again !!!" is a bit too strong of an assessment.

Neldon just "kind'a" won, because he can't lose a case that won't be held.

The case was actually a foregone conclusion against Neldon & Glenda (RIP) because a witness saw them discarding pertinent information after being ordered to deliver everything to the court.

Note the term "riggers", should actually be "rigors".

A sarcastic guy might suggest that the court was rigged.

Fortunately, I'm not a sarcastic guy.

JUDGMENT entered in favor of R. Wayne Klein and against Plaskolite in the amount of $681,408.06, which constitutes $515,362.64 in principal and $166,045.42 in prejudgment interest at 5 percent from 5/14/18 through 10/21/24. Post judgment interest is awarded from the date of the entry of the judgment, at a rate equal to the weekly average 1-year constant maturity Treasury yield, as published by the Board of Governors of the Federal Reserve System, for the calendar week preceding the date of the judgment - CASE CLOSED.

Plaskolite is the company that manufactured the plastic lenses.

The settlement includes interest that accumulated from 5/14/2018 -- SIX YEARS AGO.

Apparently interest keeps accumulating until the debt is paid off. How long will that take?

Only 2 cases remain to be resolved:
2:19-cv-851 NSDP - Nelson Snuffer $2,237,000 (a scheduling conference is set for 04/08/25)

C. Recovery Litigation. Three recovery lawsuits filed by the Receiver are still active.

1. Plaskolite. On June 7, 2024, the Court denied Plaskolite's motion for summary judgment. The ruling denied various legal defenses asserted by Plaskolite and identified material facts that are established for purposes of trial. The Receiver believes this ruling will substantially narrow trial on this matter. A summary judgment motion filed by the Receiver is still pending.

2. Glenda Johnson. On May 7, 2024, the Court brought to the Receiver's attention that Glenda Johnson had died. The Receiver filed a status report describing his intent to move forward with his action against Mrs. Johnson's estate. Neldon Johnson has agreed to be appointed as personal representative for Glenda Johnson and the Receiver has filed a motion in state court for that appointment. When that personal representative appointment is confirmed, the Receiver will grant Neldon Johnson thirty days to respond
to the Receiver's motion for partial summary judgment against Glenda Johnson.

3. Nelson Snuffer. The Receiver's lawsuit against the Nelson Snuffer law firm is moving steadily towards trial. Both the Receiver and Nelson Snuffer provided reports by their various experts in June. Rebuttal expert reports are due August 16, with expert depositions to be concluded by September 16. The deadline for dispositive motions is October 16, 2024. Settlement talks have not been fruitful.

Criminal Contempt Case. The indictment against Glenda Johnson was dismissed on May 3, 2024 due to her death. Neldon Johnson's trial on criminal contempt charges was again postponed, this time to December 2, 2024. The stated reasons for the most recent postponement were ongoing plea negotiations and Mr. Johnson's health problems.

I checked into the status and activity for my favorite "Massive Fraud" case (affectionately known as: IRS/DOJ vs RaPower3 et al)

The court docket provided by the "Paid Bashers" has been updated (for free!) to include filings since October 2023 and is now current as of today.

There are several filings that pertain to the key players, and the Receiver's Status Reports contain some detail that will interest many folks who actually care about what's happening behind the scenes. In particular, read the detail reports of billable actions, and then read between the lines.

How many people knew Greg Shepard wanted to make a movie out of one of his books? I wonder how that's progressing?

The *Criminal* contempt of court trial filed against Neldon and Glenda Johnson was scheduled for late January. Not surprisingly, it has been delayed. Again. For the 4th time. This time for 180 days. The reason for the delay is provided in this excerpt from Doc #53 in case #2:21-cr-513.

Mr. Johnson’s health has deteriorated to the point that he will be unable to participate in his defense at trial. Counsel for Mr. Johnson has reviewed medical records and, as an officer of the court, declares the following: “I have independently confirmed that Neldon Johnson has the serious medical condition previously disclosed to the Court and that going to trial in his current state would make his condition worse and may prove fatal.”

That trial is now scheduled for 07/29/24.

I'm wondering what is going to happen during that 180 day delay that will make Neldon "able to participate in his defense at trial" and not "prove fatal"?

Who knows? Maybe a miracle drug will be approved by the FDA.

That's a total of $166,620.33 up to 7/5/2022 (judgment amount plus prejudgment interest), and an additional $???.?? in post judgment interest since that date.

12/09/2023 Today is ONE YEAR and one day from the notice of assignment. I wonder how much, if any, of Matt's judgment amount has been paid during the past year? And, how much more has been charged in interest if he hasn't paid it all? I doubt that he has paid it all (if any). He and his family lived in his parents' basement (which was Greg Shepard's house, before he lost it during court proceedings), so it's unlikely they were rolling in dough.

Perhaps Matt's wife's filing for divorce/annulment was somehow related to the large amount due to the DOJ? Would such a filing remove her from financial obligations he incurred for his role in the IAS/RaPower3 "massive fraud"?

Heck if know. I don't even play a lawyer on TV.

But, at least now those of you who are still interested in this fiasco have some idea of what happened, or is happening, to the key players.

After several delays and re-scheduling, his plea agreement was accepted and he was finally sentenced to prison on 5/16/2022.

Back on 07/26/2019 the court-appointed receiver filed a civil case against Randale Johnson, who is Neldon Johnson's son.

Case number: 2:19-cv-00534

The Initial claim amount was $1,143,000

The case was assigned to Judge David Nuffer. He was the judge on the underlying "Massive Fraud" civil case against IAS/RaPower3, Neldon Johnson, Greg Shepard, and Roger Freeborn (RIP)

Earlier this year, Randale's case was joined with LaGrand Johnson's case number 2:19-cv-534 for trial purposes only. They share the same underlying legal issues.

LaGrand is another one of Neldon Johnson's sons.

The Initial claim amount against LaGrand was $2,388,527.84

The two case(s) were *finally* going to court on 9/15/2023. Next month. That's over FOUR YEARS from the time the cases were filed by the Receiver.

Two weeks ago on 08/17/2023, Randale filed for bankruptcy, thus staying his case until his bankruptcy is cleared. If ever.

So, what does that mean for LaGrand's case? Does it continue to trial on 9/15/2023 as scheduled?

Or, will LaGrand file for bankruptcy also, and stay his case, too?

Strictly speaking, nobody associated with this farce is a "criminal". [Yet !!!]

While it may seem like their actions were "criminal", they're not considered actual "criminals" until a court of law deems them so.

The primary case filed by the IRS/DOJ against IAS/RaPower3/Johnson/Shepard/Freeborn was a *Civil* case (2:15-cv-000828). It resulted in the ruling by Judge Nuffer that the whole shebang was a "Massive Fraud".

The court appointed Receiver then filed over 100 *civil* cases against people or firms that profited from the "massive fraud". Almost all of them have "already" (after 8 years) been ruled in favor of the Receiver. The Receiver dropped a case or two along the way for "hardship" where the defendant could never repay their debt. There are only a few civil cases left ... most of which are cases against insiders.

After the civil trial there were some individuals who violated (or ignored) court orders and were slapped with "Contempt of Court" charges. That included Greg Shepard, who later cleared his charge by complying with the judge's orders. However, he lost his house after the Receiver won his case against him to recover Shepard's "winnings" from his involvement in the "massive fraud".

"Contempt of Court" is a *criminal* offense. Neldon and Glenda Johnson are the only two outstanding cases (that I know of) for that violation.

Their case (2:21-cr-00513) is scheduled for court on 1/22/2024. It has been delayed multiple times because of Neldon's health. As a result of prostate cancer, he is now confined to a wheel chair (at least that's what they claimed when they motioned for a continuance).

What I find interesting is that there were "Pesky Pumpers" who should have been called to testify or have a case filed against them by the Receiver but they somehow avoided such proceedings.

Like, for instance, Lyman.

He received free and/or discounted IAUS shares as an "insider", and he bought lenses. I presume he also sold lenses for a 10% (?) commission which would have put him in the group of those who profited from the "massive fraud". How did he escape all the legal fun and games? Did he realize he had been screwed royally and immediately paid his dues ... or was he granted leniency for ... sharing knowledge ... about the key players and possibly about other folks who got sucked into this mess?

I'm curious what he now thinks of his bosom buddy pals who got him into this mess? I suspect he's claiming it's a government conspiracy to keep renewable energy out of the mainstream.

Note that the above info is my interpretation of court filings. I might be a bit off about some of it, but again ... you get what you pay for.

That's how we "Paid Bashers" can afford to live the good life.

All you "Pesky Pumpers" should recognize a few names in those lists. For instance, alias "truthseeker_42" who was also "baloce" & "maverik38" & "stillthetruth" (among others) ... aka: Greg Lyman ... owned 23 lenses at the end of October 2017. He owned 30 in mid-February of 2018. So, even though there was a DOJ lawsuit filed against IAS/RaPower3/Neldon/Shepard in 2015, Lyman kept buying (or being gifted) lenses. Not too smart.

If he claimed the tax credit for those lenses, he should be required to pay the IRS $31,500 ($1,050 per lens) for overstating tax credits. And, that's not including the associated depreciation of 20% or more, depending on the rest of his tax returns for those years.

And, then there's my old retired teacher pal, "pearson_lincoln" ... aka: Lincoln [Chad] Pearson ... he owned 120 at the end of October 2017. He also owned 120 in mid-February 2018. You do the math for the tax credit and depreciation. Ouch.

It looks like he learned from his mistake and stopped buying sometime before the end of 2017. Maybe soon after the 2012 raid?

The RaPower3 "team members" who petitioned the US Tax Court after being denied their tax credit and depreciation claims will have some exciting moments soon.

On July 30, the Tax Court attorney and the petitioners' attorney have to provide a joint "what next" document outlining how to handle those 200 or so petitioners who have been awaiting the results of the appeal of the Tax Court "test case" ruling. They lost the "test case", then they lost the appeal. Surprised?

I think it was nothing but a delay tactic, because anybody who read the original Tax Court filings, then read the judge's ruling, should have been able to guess the outcome of the appeal.

Several of our ol' posting pals from Raging Bull are on the list of petitioners waiting their turn in the barrel.

Maybe I will list the names here someday of those who were the primary pumpers, along with a link to the result of their Tax Court petition.

I already have a count of how many lenses they bought. I extracted that info from a court doc back in 2015. Eight years ago.

With that count, it should be relatively easy to come up with a rough estimate of how much they will owe in back taxes. We can also guesstimate how much they will owe in compounded interest for the several years after the taxes were originally due.

Isn't posting info like that what you would expect from a guy they used to call "Evil TED" ???

Ouch.

Note that pre-judgment interest for some of the above amounts was included in the total amount. That's the number following the "+" sign. Some of the Receiver's filings did not include details of the pre-judgment interest, so that would have to be added into their total to be collected by the IRS.

Also, post-judgment interest (compounded?) would be demanded by the IRS for *all* the accounts before any amounts due would be considered paid off. Some of those judgment dates were as far back as 2020. That's 5 years of interest to be added to their judgment amount.

Major Ouch.

Interest for the above amounts will continue to compound until the entire amount due is paid off. That could take years. Or, they may *never* be paid off, meaning they will forever be in debt to the IRS for whatever is left of their amounts due.

Also, the majority of those above amounts were commissions earned for selling lenses. Those amounts do not include the tax credit and depreciation amounts claimed, if any, by those people who actually believed in the IAS/RaPower3 solar power plan that sounded "too good to be true".

Add in those amounts to be paid back by the taxpayers, plus compounded interest to those amounts from the date the taxes were due.

Another Major Ouch.

Keep in mind that the above list ONLY includes judgment amounts that were assigned to the IRS by the receiver. I presume amounts for accounts that were not assigned to the IRS were already paid up, or they have a payment plan in place.

Again, the above info may be incorrect because of inadvertent manual errors or misinterpretation of the amounts included in the Receiver's status reports. YMMV.

- Glenda Johnson (Neldon's wife)
- Nelson Snuffer Dahl and Poulson (Neldon's lawyers)

Eleven more judgments have been assigned to the IRS for collection. They were added to an existing IRS list of people who did not pay their judgments. Not an enviable position for those folks. Thou shalt not pi$$ off the IRS.

As of the date of the Status Report, there were 7 active appeals from prior judgments. All 7 of those appeals have since been "Terminated on the merits after submissions without oral hearing". That should come as no surprise. In essence, the appeals were a waste of everybody's time. Did interest on those judgments continue to accumulate during the appeals process? I don't know, but it has been several years since the Receiver initially filed those claims. The interest amounts could be sizable. Add that to the judgment amounts ... ouch.

The *Criminal* contempt of court cases against Neldon and Glenda Johnson are still awaiting trial. They were stayed as a result of Neldon's poor health. A scheduling conference should be happening "soon". Considering the track record of events in this "massive fraud" mess, "soon" could take years. Will Neldon survive long enough to stand trial?

It appears we will *finally* be getting some action in all those 200+ Tax Court petitions that were filed by taxpayers who were denied the tax credit and depreciation they [invalidly] claimed for their 2008-2014 tax years. See the text below under my sign-off.

Several of those petitions were settled by the wisest petitioners with a "Stipulated Decision" in years past. Now, it's time for the rest of the petitioners to enjoy their turn in the barrel.

This case is one of more than 200 related cases involving investors in the same “energy property,” a purported solar power project in Utah. In January 2020, the cases at docket Nos. 26469-14 & 21247-16, Olsen v. Commissioner, were tried in Salt Lake City as “test cases” for the entire group. On April 6, 2021, the Court issued its opinion in Olsen, T.C. Memo. 2021-41, and on June 10, 2021, the Court entered a decision in favor of respondent. Factors For Vacating the Trial Date and Deadlines and Setting a Scheduling Conference

The following facts and specific reasons for the requested extension or continuance:

1. The reasons the Jury Trial cannot be done within the originally allotted time are:

a. Mr. Johnson has stage four cancer which has been progressively debilitating.
Originally, Mr. Johnson was ambulatory but over time has become much less so and has now
become wheelchair bound as the cancer has progressed and his health has continued to decline.
He is presently 77 years old, and as such his continuing decline and physical condition make it
impracticable for him to provide the substantial assistance to counsel necessary in the
preparation of his defense in his case. During the pendency of this case Mr. Johnson’s health
condition has been a significant concern, and the prosecution has been made aware of the
concerns related to his cancer and its progression, and the continuing decline of Mr. Johnson’s physical condition.

b. The defense counsel requires Mr. Johnson’s assistance in reviewing the voluminous
discovery, and addressing the complex issues related to the allegations (as well as the underlying
scientific methodology and concepts related to the predicate civil case). The needed
communication and participating of Mr. Johnson is necessary in order for defense counsel: (1) to advise the client as to the anticipated jury trial in this case, assist in developing the legal issues and related motions and pleadings, and to address the relative benefits associated with various aspects concerning the trial, any potential plea negotiations and the comparative risks related to going to trial. Given Mr. Johnson’s health, he cannot adequately assist counsel in the preparation of his defense at trial.

c. Mr. Wall, counsel for Mr. Johnson, has discussed these concerns Ms. Kathy Nester,
counsel for the co-defendant, and Mr. Castle, counsel for the United States and the parties agree,
given Mr. Johnson’s health and limitations, that it is in the best interest of justice and judicial
economy for all, and the court, that the trial and deadlines be vacated, and the matter set for a
scheduling conference.

Double homicide still under investigation

The case remains open and active in the double homicide of Breanda Scheets Benson, 61, and Duane Arland Benson, 62, a couple found dead in their home about two miles north of Godley in February, Jones said.

“We’ve traveled around, interviewed individuals and are now re-interviewing particular individuals,” Jones said.

The double homicide case is considered an active ongoing investigation and evidence is still being analyzed.

“It’s not like the first 48 hours of the case when you’re running at 100 mph,” Jones said.

There have not been many updates in the case since deputies found the couple murdered in their home in the 9900 block of County Road 915 while performing a routine welfare check.

After deputies found the two bodies, they decided the deaths were “under suspicious circumstances.”

There are no suspects in custody and a motive has not been determined, but Jones assured the county is still working on the case to find answers.

That was SEVEN YEARS AGO.

Yet, there are STILL some lawsuits remaining unresolved that were filed by the Court appointed Receiver against people who benefited from their involvement in what Judge David Nuffer declared to be a "massive fraud".

And, there are STILL hundreds of taxpayers who haven't paid back their invalidly claimed tax credits and deductions, even though the US Tax Court "test case" was decided against the taxpayers and in favor of the IRS ... after which an appeal by the "test case" taxpayers failed to overturn the ruling.

Will there ever be an end to this fiasco?

Several of the judgments against people who benefited from this fiasco have been turned over to the Federal Government for collection processing. That includes Matthew Shepard's case of well over $100,000.

Chris Taylor and Curtis Snow's cases are scheduled for court on Jan 9, 2023. Six weeks from now.

Neldon and Glenda Johnson's *criminal* contempt of court cases are scheduled for Jan 30, 2023.

I always asked those pesky pumpers, who would have to get paid to bash a scam? Besides, who would we would have been paid by...? Things that bewilder folks... Go figure...
