And, any state income tax adjustments.&lt;br&gt;&lt;br&gt;And, loss on IAUS stock they purchased (if any).&lt;br&gt;&lt;br&gt;There were about 200 taxpayers who petitioned the IRS after having their tax returns questioned. They relied on a test case, but the IRS won the test case.  They appealed the ruling, then lost again. So all those petitioners were left with an IRS debt. Most of those petitioners still haven&amp;#39;t come to a "Stipulated Decision" with the IRS, so interest on their debt continues to pile up.  Many of those petitioners were frequent posters on the old Raging Bull investment forum.&lt;br&gt;&lt;br&gt;And, there were many other taxpayers who voluntarily paid their debt after receiving notice from the IRS that the credits were not legal.&lt;br&gt;&lt;br&gt;Some of you may have forgotten why Matt Shepard was in jail. R. Crim. P. 48(a), moves for leave to dismiss the Indictment filed against the defendant Neldon Johnson in this case. The Indictment in this case was returned by the grand jury on December 8, 2021. On May 7, 2024, the Court brought to the Receiver&amp;#39;s attention that Glenda Johnson had died. Neldon Johnson has agreed to be appointed as personal representative for Glenda Johnson and the Receiver has filed a motion in state court for that appointment. When that personal representative appointment is confirmed, the Receiver will grant Neldon Johnson thirty days to respond&lt;br&gt;to the Receiver&amp;#39;s motion for partial summary judgment against Glenda Johnson.&lt;br&gt;&lt;br&gt;3. Nelson Snuffer. The Receiver&amp;#39;s lawsuit against the Nelson Snuffer law firm is moving steadily towards trial. Both the Receiver and Nelson Snuffer provided reports by their various experts in June. Rebuttal expert reports are due August 16, with expert depositions to be concluded by September 16. The deadline for dispositive motions is October 16, 2024. Settlement talks have not been fruitful.&lt;br&gt;&lt;br&gt;*********&lt;br&gt;&lt;br&gt;Criminal Contempt Case. In particular, read the detail reports of billable actions, and then read between the lines.&lt;br&gt;&lt;br&gt;How many people knew Greg Shepard wanted to make a movie out of one of his books?  I wonder how that&amp;#39;s progressing?&lt;br&gt;&lt;br&gt;The *Criminal* contempt of court trial filed against Neldon and Glenda Johnson was scheduled for late January.  Not surprisingly, it has been delayed.  Again.  For the 4th time.  This time for 180 days.  The reason for the delay is provided in this excerpt from Doc #53 in case #2:21-cr-513.&lt;br&gt;&lt;br&gt;&lt;i&gt;&lt;b&gt;Mr. Johnson’s health has deteriorated &lt;/b&gt;to the point that he will be unable to participate in his defense at trial. Next month. That&amp;#39;s over FOUR YEARS from the time the cases were filed by the Receiver.&lt;br&gt;&lt;br&gt;Two weeks ago on 08/17/2023, Randale filed for bankruptcy, thus staying his case until his bankruptcy is cleared. [Yet !!!]&lt;br&gt;&lt;br&gt;While it may seem like their actions were "criminal", they&amp;#39;re not considered actual "criminals" until a court of law deems them so.&lt;br&gt;&lt;br&gt;The primary case filed by the IRS/DOJ against IAS/RaPower3/Johnson/Shepard/Freeborn was a *Civil* case (2:15-cv-000828).  It resulted in the ruling by Judge Nuffer that the whole shebang was a "Massive Fraud".&lt;br&gt;&lt;br&gt;The court appointed Receiver then filed over 100 *civil* cases against people or firms that profited from the "massive fraud". Almost all of them have "already" (after 8 years) been ruled in favor of the Receiver. The Receiver dropped a case or two along the way for "hardship" where the defendant could never repay their debt. There are only a few civil cases left ... most of which are cases against insiders.&lt;br&gt;&lt;br&gt;After the civil trial there were some individuals who violated (or ignored) court orders and were slapped with "Contempt of Court" charges.  That included Greg Shepard, who later cleared his charge by complying with the judge&amp;#39;s orders. However, he lost his house after the Receiver won his case against him to recover Shepard&amp;#39;s "winnings" from his involvement in the "massive fraud".&lt;br&gt;&lt;br&gt;"Contempt of Court" is a *criminal* offense.  Neldon and Glenda Johnson are the only two outstanding cases (that I know of) for that violation.&lt;br&gt;&lt;br&gt;Their case (2:21-cr-00513) is scheduled for court on 1/22/2024. It has been delayed multiple times because of Neldon&amp;#39;s health. As a result of prostate cancer, he is now confined to a wheel chair (at least that&amp;#39;s what they claimed when they motioned for a continuance).&lt;br&gt;&lt;br&gt;What I find interesting is that there were "Pesky Pumpers" who should have been called to testify or have a case filed against them by the Receiver but they somehow avoided such proceedings.&lt;br&gt;&lt;br&gt;Like, for instance, Lyman.&lt;br&gt;&lt;br&gt;He received free and/or discounted IAUS shares as an "insider", and he bought lenses. I presume he also sold lenses for a 10% (?) commission which would have put him in the group of those who profited from the "massive fraud".  How did he escape all the legal fun and games? Not too smart.&lt;br&gt;&lt;br&gt;If he claimed the tax credit for those lenses, he should be required to pay the IRS $31,500 ($1,050 per lens) for overstating tax credits. And, that&amp;#39;s not including the associated depreciation of 20% or more, depending on the rest of his tax returns for those years.&lt;br&gt;&lt;br&gt;And, then there&amp;#39;s my old retired teacher pal, "pearson_lincoln" ... aka: Lincoln [Chad] Pearson ... he owned 120 at the end of October 2017.  He also owned 120 in mid-February 2018. You do the math for the tax credit and depreciation. That could take years. Or, they may *never* be paid off, meaning they will forever be in debt to the IRS for whatever is left of their amounts due.&lt;br&gt;&lt;br&gt;Also, the majority of those above amounts were commissions earned for selling lenses.  Those amounts do not include the tax credit and depreciation amounts claimed, if any, by those people who actually believed in the IAS/RaPower3 solar power plan that sounded "too good to be true".&lt;br&gt;&lt;br&gt;Add in those amounts to be paid back by the taxpayers, plus compounded interest to those amounts from the date the taxes were due.&lt;br&gt;&lt;br&gt;Another Major Ouch.&lt;br&gt;&lt;br&gt;Keep in mind that the above list ONLY includes judgment amounts that were assigned to the IRS by the receiver. The Tax Court ruling was affirmed back on November 4, 2022. &lt;br&gt;&lt;br&gt; Was anybody surprised?&lt;br&gt;&lt;br&gt;That decision was SEVEN YEARS after the IRS/DOJ filed suit against Neldon Johnson, Gregory Shepard, Roger Freeborn (RIP) and RaPower3.  It&amp;#39;s been a long haul.&lt;br&gt;&lt;br&gt;I&amp;#39;m wondering how many of those remaining petitioners will have to file bankruptcy as a result of buying into a tax shelter that sounded "too good to be true"?&lt;br&gt;&lt;br&gt;How many of them think Shepard is "one thousand per cent innocent" (as he claimed)?&lt;br&gt;&lt;br&gt;How many of them would have saved a bunch o&amp;#39; bux if they had just listened to what those nasty "Paid Bashes" were saying? The reasons the Jury Trial cannot be done within the originally allotted time are:&lt;br&gt;&lt;br&gt;a. &lt;b&gt;Mr. Johnson has stage four cancer which has been progressively debilitating.&lt;/b&gt;&lt;br&gt;Originally, Mr. Johnson was ambulatory but over time has become much less so and &lt;b&gt;has now&lt;br&gt;become wheelchair bound as the cancer has progressed and his health has continued to decline&lt;/b&gt;.&lt;br&gt;He is presently 77 years old, and as such his continuing decline and physical condition make it&lt;br&gt;impracticable for him to provide the substantial assistance to counsel necessary in the&lt;br&gt;preparation of his defense in his case.
